ADA Handbook from Job Accommodation Network
The purpose of the legal committee and of this page is to provide advocacy, education and timely resources to any individual who has a question or concern about rights and responsibilities of persons with disabilities. Being composed of a number of individuals with and without disabilities, the legal committee knows that its members are in a unique position to furnish informal and formal counsel and technical assistance on a range of cross-disability legal and policy matters.
The committee's goals are:
-
To utilize limited resources to resolve issues before any significant litigation is required, or to the extent that litigation is instituted, or is about to be instituted, to parlay the expertise of the committee to resolve the matter through alternative means, such as ADR or structured negotiation.
-
To utilize limited resources to provide valuable and timely comment on public policy, including, any necessary legislative advocacy
-
To utilize limited resources to serve as a point of contact on litigation matters involving individuals with disabilities through serving as a consultant on such actions, providing amicus briefs and providing referrals to a network of counsel in various states who will serve as part of a pro bono resource center
-
To educate the public, the private and non-profit sectors such that issues and concerns can be addressed before they arise, and this will be accomplished through providing timely resources to individuals who interpose inquiries, developing informational materials that can be recorded from the website and providing in-service presentations on various legal issues and concerns
-
To utilize these technical assistance functions and resource sharing as a means of developing relationships in the community, both disabled and non-disabled, which will enable us to enhance exposure about civil rights of persons with disabilities, thereby, enabling the organization to possess credibility as a source of information and dispute resolution on such matters
The strategic plan is:
-
In five years, have drafted and sponsored, and potentially passed various legislative proposals, either federally or on a local level
-
In five years, develop and produce a number of informational resources, including: PowerPoint presentations, brochures and other technical assistance documents
-
In five years, to draft and submit amicus briefs in at least five to ten significant cases. This will be a collaborative research and writing process among all members of the committee who are attorneys, or who are subject matter experts even though they may not be attorneys, under the supervision of the chair.
